It is forbidden to share or distribute the items or parts of the item as they are, or in the form of a stock, in the form of a template, included in the template, service or package. This rule applies even in the case there were changes made to the items.
It is prohibited to resell the item. This rule also applies in case the end-product was made with the help and the only value of the end-product is the item included in it (the item becomes the main part of the end-product).
You can’t claim your rights for any of the products provided within HEROCODE.PRO services and products. The sole right on all the items within the subscription belongs to HEROCODE.PRO.
You cannot claim trademark or service mark rights to the final product created using any item from HEROCODE.PRO

User Representations

By using the Site, you represent and warrant that:

All registration information you submit will be true, accurate, current, and complete;
You will maintain the accuracy of such information and promptly update such registration information as necessary;
You have the legal capacity and you agree to comply with these Terms of Use;

You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Having support for your purchased item means that the author will be available to you, the buyer, to iron-out some issues you have in using the item.

HEROCODE.PRO provides support for its own products only. We do not provide support for third-party products or services (including hosting), nor do we provide support for our own products when obtained through third parties.

Our products are provided as is. We do not provide support with product customization, alteration, or feature addition, nor do we guarantee that our products will be compatible with third-party software or services. We are ready to answer any of your questions and assist with reported bugs and issues in the theme.

Responsibility For User Content

HEROCODE.PRO respects the rights of third-party creators and content owners and expects that you will do the same. Given the nature of the Service and the volume of information submitted, we cannot and does not monitor all of the Materials (including third-party products) posted or transmitted by you and other third-parties via the Service, including, without limitation, any Materials posted via the website. When viewing the theme demos at http://herocode.pro , you will see several photographic images used. These photos serve as example images only and are not included in the membership. Our themes and plugins do not come packaged with any copyrighted photography. The photos used in the demos are purely for demonstration purposes and are used to give the visitor a functional preview of what the theme will look like once content has been added. You are responsible for adding your own thumbnail images. The photos used in our demos are licensed from http://www.shutterstock.com/ and are Copyright Shutterstock Images. These photos should not be saved, copied or redistributed in any way.

It is the policy of HEROCODE.PRO to respond to all claims of intellectual property infringement. Force Majeure

Neither party shall be liable for any failure to timely perform any of its obligations under this Agreement if such failure is caused by the occurrence of any event beyond the reasonable control of such party, including, without limitation, fire, flood, strikes, hurricanes, and other industrial disputes, failure of raw material, failure of transport, accidents, wars, riots, insurrections, pandemics, acts of God or orders of any government department or agency.

Final Provisions

ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. SUBSCRIPTIONS AND PAYMENT

After browsing our website, you may be interested in purchasing some of our HEROCODE.PRO designs. You will be required to submit payment information to do so. To process our payments we use PayPal, Stripe.com or Authorize.net. You must agree with their terms and conditions before paying for any of our products.

Refund Policy: We offer refunds to any unsatisfied customer up to thirty (30) days after the purchase was made. If you would like your money back, simply send us an email at support@herocode.pro with a description of your problem and request for a refund.

Taxes: You are solely responsible for any taxes. Although you may not be charged taxes by us, you agree that you will pay any applicable taxes or fees to your local or state tax agency for any purchases. We are not responsible for collecting, transmitting, or advising on taxes, duties, or other levies by the government regarding your purchases.

All taxes, duties and charges to be levied under this Agreement on the territory of the Seller’s country shall be paid by the Seller.

All taxes, duties and charges to be levied under this Agreement on the territory of the Buyer’s country shall be paid by the Buyer.

TERMINATION

HEROCODE.PRO reserves the right in its sole discretion, and without any prior notice, to terminate your access to the Service for any or no reason, including your breach of these Terms of Service, the terms and conditions of any service for which you may have registered, or a violation of the rights of another user or the law. You are only allowed to use the products and services of HEROCODE.PRO for their intended purpose and may not cause an unreasonable load on the HEROCODE.PRO’s servers. You may not resell, rent, sublicense or otherwise permit a third party to make any use of your account or of the Service provided. Any violation of these Terms of Service may result in termination of your access to the Service without any refund.

You may unsubscribe from any further communication from HEROCODE.PRO at any time by delivering a written notice addressed to support@herocode.pro .You shall be responsible for ensuring delivery of the notice to HEROCODE.PRO. You may also unsubscribe by clicking the Email Preferences link or the opt-out link in any of the HEROCODE.PRO emails.

HEROCODE.PRO reserves the right with or without notice to you at any time to change, modify or discontinue any service or a portion or attribute thereof, or the offering of any information, good, content, product or service. HEROCODE.PRO shall have no liability to you or any third-party should HEROCODE.PRO modify or discontinue any service or an aspect thereof.

DISPUTE RESOLUTION AND APPLICABLE LAW:

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use (each a “Dispute” and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

If the Parties are unable to resolve a Dispute through informal negotiations, they have the right to refer the lawsuit to the London Court of International Arbitration (LCIA).

This Agreement shall be governed by and construed in accordance with the laws of the UK. Matters not regulated by this Agreement shall be resolved in accordance with the laws of the UK. All possible disputes arising from the relations regulated by this Agreement shall be resolved in accordance with the procedure established by the legislation of the UK in force. Throughout the text of this Agreement, unless explicitly stated otherwise, the term “legislation” shall be understood to mean the legislation of the UK.

These Terms of Service, together with the Privacy Policy and any other legal notices published by us on the Service, shall constitute the entire agreement between you and us concerning this Service and supersedes any prior written or oral representations. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. These Terms of Service may not be transferred or assigned by you but may be assigned by HEROCODE.PRO without restriction.
